Tevkil, Adliyedeyim and Courthouse Guide Terms of Use and Membership Agreement

1. Parties and purpose

These Terms of Use and Membership Agreement (the “Agreement”) are entered into between Raci Eren Denizoğlu (the “Platform Provider”) and the natural person who registers with or uses the Platform (the “User”) in order to set out the terms of use of the digital services offered through the Platform and the rights and obligations of the parties.

2. Definitions

  • Platform: the mobile application and website operated by the Platform Provider under the name “meslektaş”,
  • Trainee Lawyer and Clerk User: natural persons registered with the Platform who are trainee lawyers completing their legal internship, or clerks and office staff working at law offices,
  • Lawyer User: a user who registers with the Platform declaring that they practise as a lawyer registered with one of the bar associations in Türkiye under Attorneyship Law No. 1136,
  • Tevkil Module: the area where Users post listings for professional assignments such as hearings, file reviews, attachment proceedings and court registry work, apply to listings and message each other in the app (“tevkil” is the delegation of a task to a fellow lawyer),
  • Adliyedeyim Module: the area where Users who are within 1 km of a supported courthouse may optionally announce to other users that they are available for work at that courthouse; the User’s location is not shown to other users,
  • Courthouse Guide: the information module that provides access to courthouse buildings, registries, units and general institutional information.

3. Nature of the service and legal role of the Platform

3.1. With respect to content created by users, the Platform is a “hosting provider” within the meaning of Law No. 5651 and a technical infrastructure provider.

3.2. The Platform is in no way a law partnership, legal consultancy, client, employer or intermediary. No legal opinion is given and no legal services are sold through the Platform.

3.3. Under Articles 35 and 63 of Attorneyship Law No. 1136, the legal profession’s exclusive right to practise is absolute. Work that only lawyers may perform under the Attorneyship Law may be assigned through the Platform only to Lawyer Users; Trainee Lawyer and Clerk Users may not undertake such work or practise law. Ensuring that a task is given to a person eligible under the legislation is the responsibility of the Users who post and apply to the listing.

4. Membership requirements and identity verification

4.1. Registration is made with a phone number and password; the phone number is verified by SMS during registration.

4.2. The User must declare their name and surname, role (lawyer, trainee lawyer or clerk), bar association, registration number and year of starting the profession accurately and keep them up to date. The Platform Provider does not automatically verify this information against bar association records; the User is responsible for the accuracy of the declaration.

4.3. The accounts of Users found to have falsely declared a professional title, or to have been removed from or suspended on the bar register, may be closed, and legal action may be taken against them before the Chief Public Prosecutor’s Office and the relevant Bar Association.

5. Rights and obligations of the parties

5.1. Tevkil assignments and responsibility:

  • The tevkil relationship between Lawyer Users is an independent mandate relationship; the Platform is not a party to or guarantor of this relationship.
  • Payment of the tevkil fee, issuing the authority document, and performing the file review and hearing in accordance with professional rules are entirely the responsibility of the Lawyer Users concerned.
  • The Platform can in no way be held liable for the non-performance, incomplete or defective performance of tevkil assignments, for missed limitation or preclusive periods, or for fee disputes.

5.2. Adliyedeyim module:

  • The User is personally responsible for ensuring that the availability they announce through this module reflects the truth.
  • Statuses shared through the module may not be used for purposes that disturb public order or the peace of third parties.

5.3. Courthouse Guide:

  • Registry, room and phone information in the guide is for general information, and verifying it with official sources is recommended. The Platform cannot be held at fault for registries that have moved.

6. Fees and payment terms

The services offered by the Platform are free of charge. Tevkil fees are not collected through the Platform; they are paid directly between Users. If a paid service is offered in the future, its scope, price and payment terms will be stated clearly on the relevant screen in advance and the User’s separate consent will be obtained.

7. Intellectual property

Copyright and intellectual property rights in the Platform software, design, logo and the arrangement of its database belong to the Platform Provider. Information in the Courthouse Guide is compiled from public official sources of bar associations and courthouses. Unauthorised bulk copying or crawling (scraping) of Platform content and reverse engineering are prohibited.

8. Limitation of liability

The Platform is provided as is; it is not guaranteed that it will operate without interruption or error, or that data will never be lost under any circumstances. The Platform Provider may change, restrict or discontinue the service with or without prior notice.

The Platform Provider cannot be held directly or indirectly liable for data loss and damage caused by force majeure, interruptions originating from telecommunications infrastructure, cyber attacks or the fault of users.

These limitations do not cover cases of wilful misconduct or gross negligence by the Platform Provider.

9. Termination and entry into force

This Agreement enters into force when the User accepts it electronically and remains in force until the membership ends. The Platform Provider may unilaterally terminate, without compensation, the membership of Users who act in breach of the rules. The User may end their membership at any time from within the app (Profilim › Hesap ve gizlilik › Hesabı sil).

10. Changes

The Platform Provider may amend this Agreement. The current text is always published in the app and on the website with its last updated date. A User who continues to use the Platform after a change is deemed to have accepted the current text.

11. Governing law and disputes

This Agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes.

Disputes arising from the tevkil relationship between Users are between the Users; the Platform Provider is not a party, mediator or arbitrator in such disputes and does not intervene in them (clause 5.1).
